Terms and Conditions

1. Introduction

These Terms and Conditions govern the use of services provided by GoToWebsites, a trading name of JTWI LTD. By using our services, you agree to these terms.

2. Definitions

Client: Refers to any individual or business engaging GoToWebsites' services.
Services: Website design, hosting, maintenance, SEO, and related digital services.
Project: The specific services defined in the contract between GoToWebsites and the Client.

3. Scope of Services

GoToWebsites will deliver services as outlined in the Service Agreement or project proposal. Additional services requested outside the original scope will require an updated agreement and may incur extra costs.

4. Payment Terms

4.1 Subscription Payments: Payments are processed monthly via Stripe. Failed payments incur a 5% late fee after 2 days and services are suspended after 7 days. Legal action may be taken if unresolved.
4.2 Invoicing and Receipts: Receipts are sent automatically via Stripe.

5. Intellectual Property

GoToWebsites retains ownership of all content, design, and code created for the Client until full payment is received. Upon payment, the Client will have full rights to the deliverables.

6. Hosting and Service Availability

GoToWebsites guarantees 99.9% uptime for hosted websites, excluding scheduled maintenance or circumstances beyond our control. Scheduled maintenance will be communicated 48 hours in advance.

7. Confidentiality

Both parties agree to maintain confidentiality for proprietary or sensitive information shared during the contract period. This obligation extends two years beyond termination.

8. Limitation of Liability

GoToWebsites' liability is limited to the total fees paid by the Client. We are not liable for indirect, incidental, or consequential damages.

9. Termination

9.1 The Client may terminate the agreement with 30 days' written notice prior to the subscription period's end for website plans (minimum 12-month commitment).
9.2 Email plans are non-cancellable within the 12-month contract.
9.3 GoToWebsites reserves the right to terminate if the Client breaches any terms, including non-payment, after 7 days' notice.

10. Out-of-Hours Support

Standard support is available Monday to Friday, 10 AM to 7 PM, and Saturday, 10 AM to 1 PM. Out-of-hours support is billed at £20/hour.

11. Amendments

GoToWebsites reserves the right to modify these Terms and Conditions. Significant changes will be communicated to the Client and require mutual agreement.

12. Data Protection and GDPR Compliance

GoToWebsites complies with the UK Data Protection Act 2018 and the GDPR. We handle personal data in line with our Privacy Policy, available on our website.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales. Disputes will be resolved in the courts of England and Wales, with mediation attempted before legal proceedings.
